In many ways, having a Lasting Power of Attorney is as important as making a Will – and like a Will, the most important thing is to make it before we need it.
A Lasting Power of Attorney is a document that gives authority to your chosen and trusted individuals to make decisions and sign documents on your behalf when you may be less able to do so. This can be either for practical reasons or for health reasons.
In some ways, a Lasting Power of Attorney is like an insurance policy: we hope we never have to need them, but it offers peace of mind that it is in place and ready to be called upon. Importantly, in the event we ever do need to use it, it will be there for us.
Why make a Lasting Power of Attorney?
Where a loved one has developed a physical or mental health condition that means it is either harder for them to attend to their affairs or health decisions or impossible for them to do so, a Lasting Power of Attorney is invaluable to families to enable them to step in.
Without a Lasting Power of Attorney in place, your loved ones may not be able to access your assets or estate, potentially resulting in issues ranging from not paying your bills to being unable to make health and medical decisions on your behalf.
Last Power of Attorney can also be valuable to have in place if you are away from your normal home for long periods of time and you want some to be able to manage your affairs for you in your absence.
The most important requirement of making a Lasting Power of Attorney is that it is done and set in place while you are able understand the documents fully. Naturally this means we need to make them before we need them.
Types of Lasting Power of Attorney
There are two types of Lasting Power of Attorney: one for Property and Financial affairs, and one for your Health and Care decisions.
